LTL Obtains Sweeping Defense Victory in International Arbitration

LTL Attorneys LLP (LTL) obtained a complete arbitration victory on behalf of one of the world’s leading manufacturers of flash memory storage devices and software solutions. The four-year dispute involved claims of unfair competition by one of the company’s former foreign distributors. The case included a multitude of issues such as contract interpretation, international freight policies, accounting practices, and complex damages disputes. It also required extensive international discovery including foreign depositions.

Following a five-day arbitration at the American Arbitration Association (AAA), the distributor’s claims, which originally sought millions of dollars in damages, were denied in their entirety. Instead, the Arbitrator issued an offset award in favor of LTL’s client and ordered the Claimant to pay all arbitration expenses.

LTL’s arbitration team included partners Enoch H. Liang and Eugene L. Hahm, and associate Tiffany S. Hansen, all based in LTL’s San Francisco office. “We could not have achieved a better outcome and are thrilled with the result,” said managing partner Enoch H. Liang. “The outcome is the result of LTL’s focus, determination and experience in devising and executing a winning litigation strategy in close partnership with our client. As with every case, LTL was singularly focused on achieving our primary goal – to deliver the best for our clients.”
